The Library District is dedicated to the principles of equal employment opportunity (EEO). We prohibit unlawful discrimination against applicants or employees on the basis of age 40 and over, race (including traits historically associated with race, such as hair texture and length, protective hairstyles), sex, sexual orientation, gender identity, gender expression, color, religion, national origin, disability, military status, genetic information, or any other applicable status protected by state or local law.

Accommodation under Americans with Disabilities Act and Religion

The Library District will make reasonable accommodation for qualified individuals with known disabilities unless doing so would result in an undue hardship to the Library District or cause a direct threat to health or safety. The Library District will make reasonable accommodation for employees whose work requirements interfere with a religious belief, unless doing so poses undue hardship on the Library District.

Pregnancy Accommodation

Employees have the right to be free from discriminatory or unfair employment practices because of pregnancy, a health condition related to pregnancy, or the physical recovery from childbirth.

Employees who are otherwise qualified for a position may request a reasonable accommodation related to pregnancy, a health condition related to pregnancy or the physical recovery from childbirth. If an employee requests an accommodation, the Library District will engage in a timely, good-faith, and interactive process with the employee to determine whether there is an effective, reasonable accommodation that will enable the employee to perform the essential functions of their position.  A reasonable accommodation will be provided unless it imposes an undue hardship on the Library District’s business operations.

The Library District may require that an employee provide a note from their health care provider detailing the medical advisability of the reasonable accommodation. Employees who have questions or who wish to request a reasonable accommodation  should contact human resources.

The Library District will not deny employment opportunities or retaliate against an employee because of an employee's request for a reasonable accommodation related to pregnancy, a health condition related to pregnancy, or the physical recovery from childbirth.  An employee will not be required to take leave or accept an accommodation that is unnecessary for the employee to perform the essential functions of the job.

Unlawful EEO Harassment

The Library District strives to maintain a work environment free of unlawful harassment. Unlawful harassment includes verbal or physical conduct that has the purpose or effect of substantially interfering with an individual’s work performance or creating an intimidating, hostile, or offensive work environment. Prohibited behavior may include but is not limited to the following:

  • Written form such as cartoons, e-mail, posters, drawings, or photographs.
  • Verbal conduct such as epithets, derogatory comments, slurs, or jokes.
  • Physical conduct such as assault, or blocking an individual’s movements.

This policy applies to all employees including directors, managers, supervisors, co-workers, and non-employees such as patrons, vendors, consultants, etc.

Sexual Harassment

Because sexual harassment raises issues that are to some extent unique in comparison to other harassment, the Library District believes it warrants separate emphasis.

The Library District strongly opposes sexual harassment and inappropriate sexual conduct. Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature, when:

  • Submission to such conduct is made explicitly or implicitly a term or condition of employment.
  • Submission to or rejection of such conduct is used as the basis for decisions affecting an individual’s employment.
  • Such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive work environment.

All employees are expected to conduct themselves in a professional and businesslike manner at all times. Conduct which may violate this policy includes, but is not limited to, sexually implicit or explicit communications whether in:

  • Written form, such as cartoons, posters, calendars, notes, letters, e-mails.
  • Verbal form, such as comments, jokes, foul or obscene language of a sexual nature, gossiping, or questions about another’s sex life, or repeated unwanted requests for dates.
  • Physical gestures and other nonverbal behavior, such as unwelcome touching, grabbing, fondling, kissing, massaging, and brushing up against another’s body.

 EEO/Harassment Complaint Procedure

If you believe there has been a violation of the EEO policy or harassment based on a  protected class, including sexual harassment, please use the following complaint procedure. The Library District expects employees to make a timely complaint to enable a prompt investigation and correct any behavior that may be in violation of this policy.

Report the incident to the Manager of Human Resources or the Director of People Services who will investigate the matter and take corrective action. Your complaint will be kept as confidential as practicable. If you prefer not to report your complaint to either of these individuals, you should report the incident to your supervisor.

The Library District prohibits retaliation against an employee for filing a complaint under this policy or for assisting in a complaint investigation. If you perceive retaliation for making a complaint or your participation in the investigation, please follow the complaint procedure outlined above. The situation will be investigated.

If the Library District determines that an employee’s behavior is in violation of this policy, disciplinary action will be taken, up to and including termination of employment.

IGUALDAD DE OPORTUNIDADES DE EMPLEO Y EL ACOSO SEXUAL

El Distrito de la Biblioteca prohíbe las represalias contra un empleado por presentar una queja bajo esta política o por ayudar en la investigación de una queja. Si usted percibe represalias por presentar una queja o por su participación en la investigación, por favor siga el procedimiento de quejas que se describe a continuación. La situación se investigará inmediatamente.

Adaptación ADA

  • De forma escrita, como dibujos animados, correo electrónico, carteles, dibujos o fotografías.

Acoso Sexual

Debido a que el acoso sexual plantea cuestiones que son hasta cierto punto únicas en comparación con otros acosos, el Distrito de la Biblioteca cree que merece un énfasis por separado.

El Distrito de la Biblioteca se opone firmemente al acoso sexual y a la conducta sexual inapropiada. El acoso sexual se define como las insinuaciones sexuales no deseadas, las solicitudes de favores sexuales y otras conductas verbales o físicas de naturaleza sexual, cuando:

  • El sometimiento a dicha conducta se convierte explícita o implícitamente en un término o condición de empleo.
  • La sumisión o el rechazo de dicha conducta se utiliza como base para las decisiones que afectan al empleo de una persona.
  • Dicha conducta tiene el propósito o el efecto de interferir sustancialmente en el rendimiento laboral de una persona o de crear un entorno de trabajo intimidatorio, hostil u ofensivo.

Se espera que todos los empleados se comporten de manera profesional y profesional en todo momento. Las conductas que pueden infringir esta política incluyen, entre otras, las comunicaciones sexualmente implícitas o explícitas, ya sea en:

  • Forma escrita, como dibujos animados, carteles, calendarios, notas, cartas, correo electrónico.
  • De forma verbal, como comentarios, bromas, lenguaje grosero u obsceno de carácter sexual, chismes o preguntas sobre la vida sexual de otra persona, o peticiones repetidas de citas no deseadas.
  • Gestos físicos y otros comportamientos no verbales, como tocar, agarrar, acariciar, besar, masajear y rozar el cuerpo de otra persona.

Procedimiento de reclamación de EEO/acoso

Si usted cree que ha habido una violación de la política de EEO o acoso basado en las clases protegidas descritas anteriormente, incluyendo el acoso sexual, por favor utilice el siguiente procedimiento de queja. El Distrito de la Biblioteca espera que los empleados presenten una queja a tiempo para permitir una investigación rápida y corregir cualquier comportamiento que pueda estar en violación de esta política.

Comunique el incidente al Director de Recursos Humanos o al Director de Mercadotecnia y Relaciones Humanas, quienes investigarán el asunto y tomarán medidas correctivas. Su queja se mantendrá tan confidencial como sea posible. Si prefiere no dirigirse a ninguna de estas personas con su queja, debe informar del incidente a su supervisor.

Si el Distrito de la Biblioteca determina que el comportamiento de un empleado viola esta política, se tomarán medidas disciplinarias contra el empleado infractor, que pueden incluir el despido.

 Библиотечный район запрещает преследование сотрудника за подачу жалобы в соответствии с этой политикой или за помощь в расследовании жалобы. Если вы подвергаетесь преследованию за подачу жалобы или ваше участие в расследовании, пожалуйста, следуйте процедуре подачи жалобы, описанной ниже. Инцидент будет соответствующим образом расследован.

Библиотечный район стремится поддерживать рабочую среду, свободную от незаконных притеснений. С этой целью Компания запрещает незаконные притеснения по признаку возраста старше 40 лет, расы, пола, цвета кожи, религии, национального происхождения, инвалидности, сексуальной ориентации или любого другого охраняемого законом статуса. 

Незаконное притеснение включает словесное или физическое поведение, целью или результатом которого является существенное вмешательство в работу человека или создание запугивающей, враждебной или оскорбительной рабочей среды. Действия, основанные на отношении к расе, цвету кожи, национальному происхождению, религии, инвалидности или любым другим характеристикам, охраняемых законом, недопустимы. Запрещенное поведение включает, но не ограничивается следующим: 

  • Письменная форма, такая как карикатуры, электронные письма, плакаты, рисунки или фотографии.

  • Подчинение или отказ от такого поведения используется в качестве основы для решений, влияющих на трудоустройство человека. 
  • Целью или следствием такого поведения является существенное вмешательство в работу человека или создание запугивающей, враждебной или оскорбительной рабочей обстановки. 

От всех сотрудников ожидается, что они при любых обстоятельствах будут вести себя профессионально и по-деловому. Поведение, которое может нарушать эту политику, включает, помимо прочего, сексуальное подразумеваемое или явное общение, будь то в: 

  • Письменной форме, например, карикатуры, плакаты, календари, записки, письма, электронные письма. 
  • Словесной форме, например, комментарии, шутки, нецензурные выражения или матерная брань сексуального характера, сплетни или вопросы о чужой сексуальной жизни, повторяющиеся нежелательные просьбы о свиданиях. 
  • Виде физических жестов и другого невербального поведения, например, нежелательные прикосновения, хватания, приставания, поцелуи, массаж и касание другого тела. 

Процедура подачи жалобы на притеснение равных возможностей занятости 

Если вы считаете, что имело место нарушение политики равных возможностей при трудоустройстве или домогательства на основании перечисленных выше защищенных категорий, включая сексуальные домогательства, воспользуйтесь следующей процедурой подачи жалобы. Библиотечный район ожидает, что сотрудники своевременно подадут жалобу, чтобы обеспечить быстрое расследование и исправить любое поведение, которое может нарушать эту политику. 

Сообщите об инциденте менеджеру по персоналу или директору по маркетингу и связям с персоналом, которые должны провести расследование и предпринять корректирующие действия. Ваша жалоба будет сохранена в конфиденциальности. Если вы предпочитаете не обращаться ни к одному из этих лиц со своей жалобой, вы должны сообщить об инциденте своему руководителю. 

Если библиотечный район установит, что поведение сотрудника нарушает эту политику, к нарушившему его сотруднику будут применены дисциплинарные меры, вплоть до увольнения.
